Terms of Service

These Terms of Service ("Terms") govern your use of the BioBiz mobile application (the "App") provided by BioBiz Team ("we", "us", or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Account Responsibilities

To use the App, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Keeping your account information up to date
• Notifying us promptly if you suspect unauthorized access to your account

You must be at least 13 years of age to create an account and use the App.

2. Acceptable Use

You agree to use the App only for lawful purposes. You may not:

• Use the App to harass, abuse, or harm others
• Upload content that is unlawful, defamatory, obscene, or infringes on the rights of others
• Impersonate another person or entity on your business card
• Attempt to gain unauthorized access to the App, its servers, or other users' accounts
• Use the App to distribute spam, malware, or other harmful content
• Reverse-engineer, decompile, or disassemble any part of the App
• Record audio using the AI Notetaker feature without the knowledge and consent of all parties being recorded, where required by applicable law
• Use the App in any manner that could interfere with or disrupt the service

3. Content Ownership

You retain full ownership of all content you create, upload, or store through the App, including your business card information, profile photos, company logos, contacts, and transcription notes.

By using the App, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the App's features and services to you. We do not claim ownership of your data.

You are solely responsible for the content you upload and share. You represent that you have the necessary rights to use and share any content you provide through the App.

4. Service Availability

The App is provided on an "as-is" and "as-available" basis. We do not guarantee that the App will be available at all times or without interruption. We may:

• Modify, suspend, or discontinue any part of the App at any time
• Perform maintenance that may temporarily affect availability
• Experience outages due to circumstances beyond our control

We make no warranties, express or implied, regarding the App's reliability, accuracy, fitness for a particular purpose, or non-infringement.

5. Third-Party Services

The App relies on third-party services including Supabase (for authentication and data storage) and the Groq Whisper API (for audio transcription). We are not responsible for the availability or performance of these third-party services. Your use of features that depend on third-party services is also subject to their respective terms and policies.

6. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your account if:

• You violate these Terms
• Your use of the App poses a risk to other users or the service
• We are required to do so by law
• We discontinue the App

Upon termination, your right to use the App ceases immediately. We may delete your account data following termination, subject to any legal retention requirements.

7. Limitation of Liability

To the fullest extent permitted by applicable law, BioBiz Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App. This includes, but is not limited to, damages for loss of data, loss of profits, business interruption, or any other commercial damages or losses.

Our total liability for any claim arising from or related to these Terms or the App shall not exceed the amount you have paid us, if any, in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

8. Indemnification

You agree to indemnify and hold harmless BioBiz Team from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

9. Changes to These Terms

We may update these Terms from time to time. Changes will be posted within the App, and the effective date at the top of this page will be updated. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the App.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
